Using this site

This website is published by Atkinson Designs, a trading name of William Atkinson, ABN 72 624 376 563, operating from Sydney's Northern Beaches and working across New South Wales.

The writing, layout, code and images on this site are owned by William Atkinson, except where they show work built for or about someone else. You are welcome to read it, share links to it, and quote from it with attribution. Reproducing whole pages or the design itself is not on.

The prices on this site

The prices on the pricing page are current and complete. Each package is a one-time build price plus a monthly upkeep, both stated in Australian dollars, and nothing is added at invoice. If prices change, the change applies to new work only. A price already quoted to you in writing is held for 30 days, and an upkeep amount already agreed is held for at least twelve months, after which any change is notified at least 30 days before it takes effect.

Turnaround times are honest estimates based on the work actually taking that long. They assume you supply content and feedback when asked. If a project stalls waiting on something from your end, the finish date moves by about that much, and you will be told at the time rather than at the end.

How an engagement works

• A written scope is agreed before anything starts, including which package, what is included, and the number of revision rounds.
• Half the build price is payable to begin. The balance is payable on completion, before the site goes live.
• Monthly upkeep is part of every package, not an optional extra, and starts once the site is live. It covers hosting, the domain name and its renewal, uptime monitoring, security updates, and small content and image changes. The amount for your package is stated on the pricing page.
• Upkeep can be stopped at any time with one month's notice. There is no minimum term and no exit fee. If you stop it, the site files are handed to you so the site can be hosted anywhere, and the domain name is transferred into your name at no charge within five business days of your request.
• Revision rounds are as listed for the package. Work beyond the agreed scope is quoted separately, in writing, before it is done. You will never receive a surprise invoice.
• Your domain name is registered and renewed by me, and its cost is covered by your monthly upkeep. It is held in my registrar account while I look after your site. At any time, for any reason, including if you stop the upkeep, it is transferred into your name at no charge within five business days of your request, and I will not withhold it over an unpaid amount. Your Google Business Profile is verified by you and is in your name throughout.
• Ownership of the finished design work, including the logo and the site files, passes to you on final payment. Until then it is licensed to you for review.
• Fonts, stock images and third-party tools used in your project are licensed appropriately, and you are told what is licensed and on what terms.
• Either of us can end an engagement in writing. If you end it, you pay for work genuinely done up to that point and any unused part of the deposit is refunded. If I end it, any amount you have paid beyond work done is refunded.

Showing your project as an example

Your project is not shown on this site, or anywhere else, without your written permission. If you would rather it stayed private, say so and that is the end of it. No explanation needed.

Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, and any term that tried to would have no effect. Services come with guarantees that cannot be excluded, including that they are provided with due care and skill and within a reasonable time.

Beyond those guarantees, and to the extent the law allows it, liability for any claim connected with the work is limited to supplying the services again or paying the cost of having them supplied again.

Governing law

These terms are governed by the law of New South Wales, Australia.
